So, how do you suppose Harriet Miers would have voted on the ObamaCare case?
Just thinking, there might be one other good thing about Justice Roberts’s ruling: maybe it ensures that it will be quite a while before another Republican President equates Ivy League credentials with strong character and good judgment.
I’m not averse to justices on our highest court receiving their education in the law at Ivy League universities, but I would really love to see some different backgrounds in terms of work experience on the court. To my knowledge, only four of the sitting justices, Thomas, Roberts, Alito, and Sotomayor, did not come to the court via academia. While academia is not bad training for the court, neither is public service, or a whole host of non-academic experiences.
